Acquisition of personal data

1 We process personal data (all information that relates to you, an identified or identifiable natural person) that we receive from you or involved third parties within the scope of the mandate you have given us or that we collect ourselves. Wenfei Attorneys-at-Law Ltd. is responsible for the processing of personal data described in this Privacy Policy.

2 You or the persons concerned provide us with some of the personal data yourself when you or the persons concerned contact us by e-mail or telephone and request our services. This includes, for example, name and contact details as well as information about the role of the data subject in the company or organization for which you or the respective contact persons work or on whose behalf you or they contact us. We also process personal data (e. g. name, contact data, date of birth, information on the employment relationship, income situation, family relationships or state of health) that we receive in our correspond-dence with third parties (namely with the client, counterparties, authorities and courts and their employees or other contact persons) when we fulfill our mandate. We collect some personal data ourselves, e. g. from public registers or websites.

Data processing and processing purposes

3 We process these types of personal data mainly to provide, document and invoice our legal services. We have a legitimate interest in processing personal data for these purposes. Some processing is necessary for us to fulfill our contractual obligations to you or our legal obligations (e. g. storage obligations).

4 In addition, we process the contact details of clients or their employees or other contacts for marketing purposes (using any means of communication such as e-mail, social media, mail, or telephone) to provide information about publications, events, news, services, or products that may be of interest to the individuals concerned.

5 To achieve these purposes, it may be necessary for us to disclose personal data to the following categories of recipients: external service providers, clients, counterparties and their legal representatives, business partners with whom we may need to coordinate our delivery of legal services, and public authorities and courts.

6 To provide our legal services, we may also transfer personal data to recipients (namely clients, counterparties, or authorities) who process the personal data in other countries, including countries that do not ensure a level of data protection comparable to Swiss law. We will do the latter based on consent or standard contractual clauses, or if it is necessary for the performance of a contract or the enforcement of legal claims.

7 We will archive and store personal data only for as long as is necessary to process the client relationship, for as long as there is a legal obligation to retain and/or document the data, or for as long as we have an overriding private interest in doing so, or for as long as there is a public interest in doing so. We take proportionate and reasonable precautions to protect personal data from loss, unauthorized modification, or unauthorized access by third parties.

8 If you disclose personal data of third parties to us (e. g. through your employees or other contacts), it is up to you to inform the data subjects in a general manner about the processing by legal service providers (such as us) or other external service providers (e. g. via the privacy policy for employees).

Disclosure of data abroad

9 We may disclose personal data to a country without adequate data protection without concluding a separate contract for this purpose if we can rely on an exceptional provision. Such an exception exists if we are conducting legal proceedings for you abroad. There are further exceptions if the provision of our legal services to you requires us to disclose personal data to such a country, or if the performance of a contract that is in your interest requires disclosure to such a country (e. g. if we disclose personal data to our lawyers working in China, to partner law firms or to your contractual partners). In the absence of exceptions, we would obtain your explicit consent to disclose personal data to such a country in each individual case.

10 We would like to point out that we use external IT service providers and cloud providers with servers as part of our mandate. The data is stored on servers in Switzerland and China. Please let us know if you require special security measures in this regard.

Rights of the data subjects

11 Data subjects have the right to obtain information about what personal data is stored and for what purpose it is processed, the right to rectification as well as to erasure or restriction of the processing of their personal data, the right to object to the processing, the right to seek redress from the competent supervisory authority and the right to data transfer/transferability. Please note that these rights have conditions and exceptions. To the extent permitted or required by law, we may refuse requests to exercise these rights. For example, we may or must retain or continue to process personal data despite a request to delete the personal data or restrict processing for legal reasons.

12 The privacy policy serves to provide information on the type, scope, and purpose of the use of personal data by Wenfei Attorneys-at-Law Ltd. Wenfei Attorneys-at-Law Ltd. reserves the right to unilaterally change the content of the privacy policy at any time without notice. We recommend that you regularly consult the privacy policy of Wenfei Attorneys-at-Law Ltd. e. g. on our website.
